Your Data Rights

Data Subject Rights under GDPR

Under the General Data Protection Regulation (GDPR), you have specific rights regarding your personal data. This page explains each right, how to exercise it, and our response commitments.

Right of Access (Article 15)

You have the right to obtain confirmation of whether we process your personal data and, if so, to receive a copy of that data along with information about how it is processed. You can export your data directly from the Arivit app settings, or contact us for a formal Subject Access Request.

Right to Rectification (Article 16)

You have the right to have inaccurate personal data corrected without undue delay. You can update your name and profile information directly in the app. For other corrections, contact us at privacidad@arivit.app.

Right to Erasure (Article 17)

You have the right to request deletion of your personal data. You can delete your account directly from the app settings, which triggers immediate anonymisation or permanent deletion of all your data. We may retain data where required by law (e.g., billing records for tax compliance).

Right to Restriction (Article 18)

You have the right to restrict the processing of your data in certain circumstances, including: when you contest the accuracy of the data, when processing is unlawful but you oppose erasure, when we no longer need the data but you need it for legal claims, or when you have objected to processing pending verification.

Right to Data Portability (Article 20)

You have the right to receive your personal data in a structured, commonly used, machine-readable format (JSON). Use the data export feature in the app to download your data. You may also request that we transmit your data directly to another controller where technically feasible.

Right to Object (Article 21)

You have the right to object to processing based on legitimate interest (Article 6(1)(f)). This includes our inactivity detection for safety alerts. If you object, we will stop processing unless we demonstrate compelling legitimate grounds that override your interests.

How to Exercise Your Rights

You can exercise most rights directly through the Arivit app settings (data export, account deletion, profile correction). For formal requests or rights not available in-app, email us at privacidad@arivit.app with the subject line 'Data Rights Request'. Include your full name and the email address associated with your account.

Response Time

We will respond to your request within 30 days. If your request is complex or we receive many requests, we may extend this period by an additional 60 days, but we will notify you of the extension within the initial 30-day period. Exercising your rights is free of charge. If requests are manifestly unfounded or excessive, we may charge a reasonable fee or refuse to act.

Right to Lodge a Complaint

If you believe we have not adequately addressed your request, you have the right to lodge a complaint with the Agencia Española de Protección de Datos (AEPD) at www.aepd.es. If you reside in another EU member state, you may also contact your local data protection authority.
