Acceptance of Terms
By creating an account or using Arivit, you agree to these Terms of Service. If you do not agree, you should not use the service. We may update these Terms, for example to reflect a change in the app or in the law. If a change materially affects your rights or what we do, we will tell you and ask you to accept the new version before it applies to you. Minor changes, such as corrections or clearer wording, take effect when we publish them.
Service Description
Arivit is an automated personal safety app. Based on rules you configure, it reacts to user inactivity, phone-offline events, and the wellbeing thresholds you set, then alerts your chosen trusted contacts through push notifications, SMS, and email. It is a supplementary safety tool and does not replace the emergency services (112/911).
Where Arivit is available
Arivit is currently available for Android devices, through Google Play. Purchases and cancellations are handled by Google Play under its own terms, and prices including tax are shown there before you buy.
If someone has added you as a trusted contact
Someone who uses Arivit has asked you to be one of their trusted contacts. This section is for you. You will receive alerts when Arivit notices something that may need attention, for example if the person has not used their phone for a while, or if they press the SOS button. You choose how you are contacted, and you can change that or stop being a trusted contact at any time in the app. Being a trusted contact is voluntary. You are not agreeing to be available, to respond, or to check on anyone, and these Terms do not create any legal duty for you to do so. Arivit is a supplementary tool and is not an emergency service. It cannot guarantee that an alert will reach you: your phone may be off, out of signal, or set not to show notifications. Never rely on Arivit as the only way you would find out that something is wrong, and call the emergency services (112) directly if you believe someone is in danger. We hold your name and contact details because the person who added you gave them to us. Our Privacy Notice explains what we do with them and what rights you have, including your right to object.
Safety Disclaimers
Arivit is NOT an emergency service and does NOT contact police, ambulance, or fire services. Alert delivery depends on network connectivity, device battery, and third-party services (Firebase, Twilio, Scaleway). Arivit does not guarantee that alerts will be delivered within a specific time frame. Your trusted contacts are responsible for deciding what action to take when they receive an alert. Users should always call emergency services (112 in Spain/EU) directly in life-threatening situations.
Subscription and Billing
Arivit offers a free plan and Arivit Plus, priced per person you care for. Every safety feature works on the free plan and never requires Arivit Plus: automated detection, and the full alert escalation to your trusted contacts - push, then SMS, then email - reach everyone the same way whether or not you have one. Arivit Plus adds extras and raises some limits, including how many scheduled check-ins you can set up. Prices are shown in the app before you buy, in your local currency and including any applicable taxes. Subscriptions are billed through Google Play; you can cancel at any time in your store account settings, and access continues until the end of the current billing period.
Acceptable Use
You agree to use Arivit only for its intended purpose of personal safety. You must not: use the service to stalk, harass, or monitor someone without their knowledge and consent; create accounts for fictitious persons; attempt to reverse-engineer, decompile, or exploit the service; use automated tools to scrape or abuse the API; or share your account credentials with others.
Age Requirements
You must be at least 18 years old to create and use an Arivit account. Arivit does not currently support accounts for people under 18; that capability, with appropriate parental-consent safeguards, may be added in future. In jurisdictions where GDPR Article 8 sets a different digital age of consent, the higher threshold of 18 applies.
EU Consumer Rights
If you are a consumer in the European Union, you benefit from mandatory consumer protection laws in your country of residence. Nothing in these terms affects your statutory rights under EU consumer law, including the right to a 14-day withdrawal period for online purchases (Directive 2011/83/EU). To exercise your right of withdrawal for an Arivit Plus subscription, contact us within 14 days of purchase. If you have already used the service during the withdrawal period, you may be charged a proportionate amount.
Limitation of Liability
To the maximum extent permitted by applicable law, Arivit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, without limitation, damages for failure to deliver an alert, delayed alert delivery, or actions taken or not taken by your trusted contacts. Our total liability for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
Termination
You may delete your account at any time through the app settings. Account deletion triggers immediate anonymisation or deletion of all personal data in accordance with our Privacy Notice. Arivit may suspend or terminate your account if you violate these terms, with reasonable notice where practicable. Upon termination, your right to use the service ceases immediately.
Governing Law and Jurisdiction
These terms are governed by the laws of Spain. Any disputes shall be submitted to the competent courts in Spain. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
